Terms of Service

1. Services Provided

data-runner.dev offers:

• Web scraping tools — Apify-hosted actors that extract publicly available data from third-party websites
• AI agents — AI voice automation services hosted on agents.data-runner.dev, including the AI Calling Agent (Solo and Growth tiers)
• N8n automation workflows — custom-built workflow automation services

2. Account & Eligibility

• You must be at least 18 years old and capable of entering a legally binding agreement
• You are responsible for maintaining the security of any credentials we provide
• You agree to provide accurate information when signing up or submitting onboarding forms

3. AI Agent Services — Subscriptions

AI Calling Agent subscriptions are offered in two monthly tiers and billed through Stripe: Solo ($297/mo) and Growth ($497/mo). Optional one-time white-glove setup is available for the Growth tier ($450) as an add-on.

• Subscriptions renew automatically unless cancelled before the next billing date
• Self-serve onboarding wizard configures the agent in roughly 10 minutes after checkout; white-glove setup (if purchased) is delivered within 48 hours
• You are responsible for providing accurate business information during onboarding
• We reserve the right to suspend service if payment fails after a 5-day grace period

4. Scraping Tools — Acceptable Use

You agree that when using any data extraction tool provided or linked through data-runner.dev:

• You will only scrape publicly available data and comply with the terms of service of the scraped platforms
• You will not use extracted data to send spam, harass individuals, or violate CAN-SPAM, GDPR, CCPA, or any applicable law
• You are solely responsible for how you store, process, and use any data you extract
• You will not use our tools to target protected classes or engage in discriminatory practices
• We are not responsible for changes to third-party websites that may affect scraper functionality

5. Prohibited Activities

You may not use our services to:

• Violate any law, regulation, or third-party rights
• Conduct phishing, fraud, or deceptive practices
• Reverse-engineer, resell, or sublicense our proprietary tools without written permission
• Attempt to access our systems or infrastructure without authorization

6. Intellectual Property

All code, design, content, and systems on data-runner.dev and agents.data-runner.dev are the property of data-runner.dev. You receive a limited, non-exclusive, non-transferable license to use the services for their intended purpose. You do not acquire ownership of any part of our systems.

7. Limitation of Liability

To the maximum extent permitted by law, data-runner.dev shall not be liable for:

• Indirect, incidental, or consequential damages arising from your use of our services
• Loss of revenue or business opportunities related to scraper downtime or data accuracy
• Actions taken by you or your clients using AI agent conversations
• Third-party platform changes that break scraper functionality

Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days prior to the claim.

8. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, 100% data accuracy, or that our scrapers will function indefinitely as third-party platforms change their structures.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time if you violate these terms. You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period.

10. Governing Law

These terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in the courts of Hillsborough County, Florida.

11. Changes to Terms

We may update these terms at any time. Continued use of our services after changes are posted constitutes acceptance of the new terms.
